Terms of service

You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement (Agreement) with respect to product listed. This Agreement constitutes the entire and only agreement between Graveyard Performance and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the product and services listed on the website, and the subject matter of this Agreement. This Agreement may be amended by us at any time and at any frequency without specific notice to you. The latest Agreement will be posted on this web page, and you should review this Agreement prior to purchasing the product.

INDEMNIFICATION: You agree to indemnify, defend and hold us, our officers, our shareholders, our partners, attorneys and employees harmless from any and all liability, loss, damages, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the product and services listed.

DISCLAIMER: By purchasing this product from Graveyard Performance, you are agreeing to all sections of the disclaimer.

INSTALLATION OF PRODUCT: We are not responsible for OEM or aftermarket parts of the vehicle that are damaged due to improper installation, prior to purchasing our product or service. If in doubt, please have all aftermarket parts fitted by a professional installer.

CONDITION OF VEHICLE: Graveyard Performance assumes that all vehicles used during installation through our product or service are in good working condition, and have been reviewed by the customer or professional to ensure that the vehicle will be able to handle additional power and performance. It is the customer’s sole responsibility to ensure this information is accurate. Graveyard Performance will not be held liable for any unforeseen damage that may happen to the vehicle.

SAFETY: Graveyard Performance is not responsible for improper, unsafe, reckless, or careless driving of vehicles after installing any of our products or using our services. We does not encourage violating any State or Federal laws. Items sold within assumes our product or service will be used for off-road and/or race use only.

OFF ROAD USE ONLY: All items sold through Graveyard Performance are designed for off-road/race use only, and are not for legal sale for on-road vehicles in states that require pollution controlled vehicles. *Graveyard Performance is not responsible for any price changes, mis-marked items or any other mis-printed items. Unless explicitly stated otherwise, all products sold by Graveyard Performance are designated Race Only and are solely for competition/off road use limited to racing formally sanctioned by a recognized racing organization. Any other use, including recreational off- road use, may be in violation of local, state, and Federal laws. Graveyard Performance does not implicitly or explicitly confirm the legality of using any products it sells on public roads; that is entirely the responsibility of the consumer. By purchasing items from Graveyard Performance, you are agreeing to all sections of our Disclaimer.

WARRANTY: Graveyard Performance will warranty all of our hand made fabricated products for up to 2 years to original owners. Warranty is limited and only implied to products that have not been modified or used incorrectly, unless authorized by our product management team. Graveyard Performance does not provide any warranty on 3rd party brand products, the products will be held at the manufacturer's provided warranty, replacement, and issue resolution will be determined at the manufacturer's discretion.

For the hundreds of brands that we carry, warranty claims are to be dealt with via the original manufacturer. However, if there are any questions or documentation needed, we are more than happy to assist in the warranty process!

PHOTOS OF PRODUCTS: Product images shown are for illustration/representation purposes only and may not be an exact representation of the product. Graveyard Performance reserves the right to change product images and specifications at any time without notice. If you are unsure about the product in the picture compared to the item listing please contact us before purchasing.

FREE SHIPPING: Valid within the 48 contiguous U.S. states address only. Not valid on oversized items like engines, differentials, etc or orders for items with special shipping charges. Customer is responsible for any return shipping as well. If a free shipping coupon was used an additional $10 restocking fee will be charged when returning an item

TAXES & DUTIES: Taxes will be charged at your local tax rate in states applicable. We are not responsible for any potential duty or custom fees for any parts shipped out of the US. These duties/fees are the purchaser's responsibility.

RETURNS - Unopened, uninstalled auto parts in original packaging are accepted for a return within 7 days of receipt of product. Refunds, in most scenarios, will be reduced by 5% due to the cost of processing fees. If package is open box, or outside of the 7 day return window there will be a 30% restocking fee and shipping will not be credited back. No returns allowed after 30 days of receiving of product. Credit will be issued once system is received back and inspected to be in uninstalled / original condition. Virtual products such as a Tune or Tuning License are not eligible for return or refund after delivery in any case. Built to order and Special order items will always require a restocking fee, or in most cases not be eligible for return at all. Previously installed parts are not eligible for refund, and applies to any and all parts sold by Graveyard Performance, LLC.

MISPACKS - If you suspect that your order is missing items or that you received an incorrect item, please notify Graveyard Performance within 14 days of receiving your shipment. Customers will be responsible for providing pictures or requested information regarding their shipment and order. 

CANCELLATIONS - Items that are special order or made to order are not eligible for cancellation by default. On case by case terms Graveyard may offer cancellations with a fee applied. 

PROCESSING FEES - Upon placing an order, processing fees charged by the payment processor are non-refundable. If an order is canceled and a refund to the original payment method is requested, processing fees will not be refunded by default. 

SMS/MMS MOBILE MESSAGING TERMS

By opting in to receive SMS or MMS messages from Graveyard Performance (“Graveyard Performance,” “we,” “us,” or “our”), you agree to these SMS/MMS Mobile Messaging Terms.

Program Description: By providing your mobile phone number and opting in, you agree to receive recurring text messages from Graveyard Performance at the mobile number you provided. Messages may include marketing and promotional messages, special offers, product releases, sales, cart reminders, and other promotional communications. We may also send service-related messages such as order updates, shipping notifications, account alerts, and customer service communications where applicable.

Text messages may be sent using an automatic telephone dialing system or other automated technology.

Consent: Your consent to receive marketing text messages is voluntary and is not a condition of purchasing any goods or services from Graveyard Performance.

By opting in, you represent that you are the account holder or authorized user of the mobile number you provide and that you are authorized to consent to receive text messages at that number.

Message Frequency and Charges: Message frequency varies.

Graveyard Performance does not charge you for participating in our SMS/MMS program. However, message and data rates may apply depending on your wireless carrier and mobile plan. You are responsible for any charges imposed by your wireless provider in connection with receiving or sending text messages.

Opt-Out: You may opt out of receiving marketing text messages from Graveyard Performance at any time by replying STOP to any text message you receive from us or by using the unsubscribe link provided in a message, where available.

After submitting an opt-out request, you may receive a final confirmation message confirming that you have been unsubscribed. After that, you will no longer receive marketing text messages from us unless you subsequently opt back in.

Supported Carriers: Delivery of SMS and MMS messages is subject to effective transmission by your wireless carrier and is outside of Graveyard Performance's control. Wireless carriers are not liable for delayed or undelivered messages. Availability of our messaging program may vary by carrier and mobile device.

Changes to Your Mobile Number: If you change, deactivate, or transfer your mobile phone number, you agree to opt out of our messaging program before discontinuing use of that number. You are responsible for providing us with accurate and current contact information.

Privacy: Your participation in our SMS/MMS program is also subject to our Privacy Policy. Mobile information, including phone numbers and SMS consent records, will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with service providers as necessary to operate and deliver our messaging services.

Changes to the SMS Program: We may modify, suspend, or discontinue our SMS/MMS messaging program, or modify these SMS/MMS Mobile Messaging Terms, at any time. Any changes will become effective when posted to our website. Your continued participation in the messaging program after changes become effective constitutes your acceptance of the revised terms.
